Privacy Policy for RentChek

RentChek ("RentChek," "we," or "us") is operated by Chesley Brown, and is not currently operated through an incorporated company; see our Terms of Service for details. This Privacy Policy explains what information of yours is collected by RentChek when you use the RentChek Service, how it is used, and how you can control its collection, correction, and/or deletion. We will not use or share your information with anyone except as described in this Privacy Policy. This Privacy Policy does not apply to information we collect by other means (including offline) or from other sources. Capitalized terms that are not defined in this policy are defined in our Terms of Use.

Information We Collect

User-Provided Information. You provide us information about yourself, such as your name and e-mail address, when you register for a Member account with the Service. When you use the Service to manage your rental properties, you also provide information such as property addresses, rent amounts, tenant contact information (name, e-mail, phone), lease dates, security deposits, and receipt and expense records. Tenant information is entered by the Member who manages that property, not by the tenant directly; if you are a Member, you are responsible for having an appropriate basis to provide your tenants' personal information to the Service. This information is private to your account -- it is not published to the public or to other Members, except that a receipt you generate may be sent by e-mail to the tenant named on it, at your direction.

Sign-In Information. The Service keeps you signed in using a security token stored on your device (in browser local storage on the web, or in secure, encrypted storage on iOS) rather than tracking cookies. We do not use cookies, web beacons, or similar technologies for advertising or analytics purposes.

Log File Information. Log file information is automatically reported by your browser each time you access a web page. When you register with or view our site, our servers automatically record certain information that your web browser sends whenever you visit any website. These server logs may include information such as your web request, Internet Protocol ("IP") address, browser type, referring / exit pages and URLs, and other such information.

Third-Party Service Providers. We rely on a small number of service providers to operate the Service, each of which processes some of your information on our behalf: our application servers are hosted on Heroku (a Salesforce company) and our database is hosted on MongoDB Atlas, both on servers located in the United States; e-mails sent by the Service (receipts, password resets, and other service notices) are delivered through Google's Gmail service; and we use Google Maps Platform to display property addresses on a map within the Service, which sends the relevant property address (along with your device's IP address) to Google. See Google's Privacy Policy for how Google handles that information. We do not use third-party advertising networks, ad trackers, or analytics services, and we do not serve advertisements on the Service.

How We Use Your Information

We use the information you submit to operate, maintain, secure, and provide the features and functionality of the Service to you -- including generating receipts, tracking expenses, and enabling account access and support.

By providing RentChek your email address, you consent to our using the email address to send you Service-related notices, including any notices required by law, in lieu of communication by postal mail. We may also use your email address to send you other messages, such as changes to features of the Service. If you do not want to receive non-essential messages, you may opt out by contacting us. You may not opt out of Service-related e-mails necessary for the operation of your account. If you correspond with us by email, we may retain the content of your email messages and our responses.

RentChek reserves the right, but has no obligation, to monitor the User Content you store on the Service. We reserve the right to remove any such information for any reason or no reason, including without limitation if in our sole opinion such information violates, or may violate, any applicable law or our Terms of Use Agreement, or to protect or defend our rights or property or those of any third party.

How We Share Your Information

Personally Identifiable Information. RentChek may share your personally identifiable information with third parties solely for the purpose of providing the Service to you (the service providers described above: our hosting and database providers, our e-mail delivery provider, and Google Maps Platform). If we do this, such third parties' use of your information is limited to that purpose. Your information is stored on servers operated by those hosting providers rather than on hardware RentChek controls directly.

We do not sell personal information, and we do not share it with third parties for their own advertising or marketing purposes. As we develop our business, we may buy or sell assets or business offerings; customer, email, and account information is generally one of the transferred business assets in these types of transactions.

Except as otherwise described in this Privacy Policy, RentChek will not disclose personal information to any third party unless required to do so by law or subpoena or if we believe that such action is necessary to (a) conform to the law, comply with legal process served on us, or investigate, prevent, or take action regarding suspected or actual illegal activities; (b) to enforce our Terms of Use, take precautions against liability, or to investigate and defend ourselves against any third-party claims or allegations; or (c) to exercise or protect the rights, property, or personal safety of RentChek, our Users, or others.

How We Protect Your Information

RentChek uses commercially reasonable physical, managerial, and technical safeguards to preserve the integrity and security of your personal information. We cannot, however, ensure or warrant the security of any information you transmit to RentChek and you do so at your own risk. Once we receive your transmission of information, RentChek makes commercially reasonable efforts to ensure the security of our systems. However, please note that this is not a guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.

To protect your privacy and security, we take reasonable steps (such as requesting a unique password) to verify your identity before granting you access to your account. You are responsible for maintaining the secrecy of your unique password and account information, and for controlling access to your email communications from RentChek, at all times.

If You Are a Tenant

If your landlord or property manager uses RentChek, they may have entered your contact information and payment history into their account. In that situation they -- not RentChek -- decide what information to record about you, why, and how long to keep it. RentChek stores it on their behalf, and has no direct relationship with you.

That means requests about your information (to see it, correct it, or have it removed) should go to your landlord or property manager first, since they control it and can edit or delete it themselves at any time. You are welcome to contact us at [email protected] and we will help where we can, but in most cases we will need to direct you back to them, and we may need to notify them of your request in order to act on it.

How Long We Keep Information

We keep your account information and records for as long as your account is open. If you delete your account, your account record, properties, tenants, receipts, and expenses are deleted from our active database at that time; residual copies may persist for a limited period in routine backups before being overwritten. We may retain a limited amount of information for longer where we are required to by law, or where it is necessary to resolve a dispute or enforce our Terms of Service.

RentChek is a record-keeping convenience, not an archival or backup service, and we do not guarantee that any information will remain available or recoverable. Please keep your own copies of anything you need for tax, legal, accounting, or tenancy-dispute purposes.

Compromise of Personal Information

In the event that personal information is compromised as a result of a breach of security, RentChek will promptly notify those persons whose personal information has been compromised, in accordance with the notification procedures set forth in this Privacy Policy, or as otherwise required by applicable law.

Your Choices About Your Information

You may decline to submit personally identifiable information through the Service, in which case RentChek may not be able to provide certain services to you. You may update or correct your account, property, or tenant information at any time by logging in to your account and editing your records. You can also request a copy of, correction to, or deletion of the information RentChek keeps on file about you by contacting us directly at [email protected].

Children's Privacy

The Service is intended for use by adults managing rental properties; registration is limited to individuals eighteen (18) years of age or older, and RentChek does not knowingly collect personal information directly from children. (This is separate from a Member entering their own tenant's contact information as described above, which is not information collected from a child by RentChek.) If you believe a child has provided us personal information directly, please contact us at [email protected] and we will delete it.

Your Privacy Rights

RentChek is operated from Canada, and your information is stored and processed on servers located in the United States (see "Third-Party Service Providers" above). By using the Service you consent to that transfer and storage. The Service is intended for use by landlords and property managers in Canada and the United States. We do not currently direct the Service to, or knowingly collect information from, residents of the European Union, European Economic Area, or United Kingdom; if you access the Service from one of those regions, you do so on your own initiative and this Policy may not reflect all rights available to you under local law.

If you are a California resident, you may request details about the personal information we hold about you, request its correction or deletion, and opt out of any sale of personal information -- though we do not sell personal information. We are not responsible for the practices employed by websites linked to or from our website, nor the information or content contained therein. Please remember that when you use a link to go from our website to another website, our Privacy Policy is no longer in effect. Your browsing and interaction on any other website, including those that have a link on our website, is subject to that website's own rules and policies. Please read over those rules and policies before proceeding.

Notification Procedures

It is our policy to provide notifications, whether such notifications are required by law or are for marketing or other business related purposes, to you via email notice, written or hard copy notice, or through conspicuous posting of such notice on our website, as determined by RentChek in its sole discretion. We reserve the right to determine the form and means of providing notifications to you, provided that you may opt out of certain means of notification as described in this Privacy Policy.

Changes to Our Privacy Policy

If we change our privacy policies and procedures, we will post those changes on our website to keep you aware of what information we collect, how we use it and under what circumstances we may disclose it. Changes to this Privacy Policy are effective when they are posted on this page.
